These Terms are a binding agreement between you and Domisomi LLC ("Domisomi," "we," "us") covering the Stratocheck iOS app, the Stratocheck backend API, and the Stratocheck Model Context Protocol endpoint (together, the "Service").
By downloading or using Stratocheck, you agree to these Terms. If you do not agree, do not use the Service.
Section 15 contains a binding arbitration agreement and a class-action waiver. It affects how disputes between us are resolved. You may opt out within 30 days. Please read it.

1. What Stratocheck is
Stratocheck is a nowcasting tool. A machine-learning model reads live GOES satellite imagery, updated roughly every five minutes, and estimates the probability that the sky above a specific point stays clear — or opens — over the next three hours, in 15-minute steps.
It is not a general weather forecast, it is not a National Weather Service product, and it is not a substitute for one. Coverage is limited to the continental United States.
2. Eligibility
You must be at least 13 years old to use Stratocheck. If you are under 18, you may use it only with the involvement of a parent or guardian who agrees to these Terms. You must have the legal capacity to enter this agreement.
3. Forecasts are probabilistic, and you accept the risk of relying on them
This section matters more than any other. Read it.
3.1 Every output is a probability, not a promise. When Stratocheck says 85%, it means that in a well-calibrated system about 15 out of every 100 such nights will not go the way the number suggests. A correct forecast that does not come true is an ordinary, expected outcome — not a defect.
3.2 Published accuracy is historical. We publish our verification record, including our misses, because we think you should be able to judge us. Past accuracy describes how the model has performed. It is not a warranty, guarantee, or prediction of future accuracy at your site, on your night.
3.3 The Service can be wrong, stale, degraded, or unavailable. Satellite feeds fail. Ground stations go offline. Imagery arrives late or corrupted. Models mispredict — in-place fog and cirrus formation are known hard cases. The app surfaces freshness and confidence indicators; you are responsible for heeding them.
3.4 Prohibited reliance. You may not use Stratocheck for aviation, marine navigation, commercial agriculture, emergency management, search and rescue, public-safety decisions, construction or industrial safety, or any other purpose where an error could contribute to death, personal injury, or significant property or financial loss. The Service is not designed, tested, certified, or insured for any of these uses, and we expressly disclaim all liability arising from them.
3.5 Stratocheck is never a substitute for official warnings. For severe weather, always rely on the National Weather Service and your local emergency authorities. Stratocheck does not detect, predict, or warn about lightning, tornadoes, hail, flooding, wind, wildfire, or any other hazard. It estimates cloud cover. That is all it does.
3.6 Your decisions are yours. Driving to a dark site, hiking a trailhead at night, planning a shoot, or setting up equipment outdoors carries real risk that has nothing to do with cloud cover. Assess conditions yourself, use your own judgment, and take responsibility for your own safety.
4. Your account
Stratocheck's core forecast works without an account. An account is required to save sites, sync across devices, hold a subscription, or mint an API token.
Accounts are created through Sign in with Apple. You are responsible for maintaining control of your Apple ID and your device, and for activity that occurs under your account. Tell us promptly at legal@domisomi.com if you believe your account has been compromised.
One person, one account. Do not share account credentials or let another person use your account.
5. Subscriptions and billing
5.1 Tiers. Stratocheck offers a free tier and one or more paid tiers ("Stratocheck Pro"). The features in each tier are described in the app and may change as described in §11.
5.2 Apple processes all payments. Subscriptions are sold through the Apple App Store. Payment is charged to your Apple ID account at purchase confirmation. We never receive or handle your payment details.
5.3 Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends, at the then-current price.
5.4 Cancelling. Manage or cancel your subscription in your Apple ID settings. We cannot cancel it for you. Cancelling stops future renewals; you keep Pro features until the end of the period you already paid for. Deleting the Stratocheck app does not cancel a subscription.
5.5 Refunds. Refunds are handled by Apple under Apple's policies, not by us. Except where the law requires otherwise, payments are non-refundable and we do not provide partial-period refunds. If Apple refunds or revokes a purchase, the corresponding entitlement ends.
5.6 Price changes. We may change subscription prices. Apple will notify you and, where required, ask for your consent before a changed price takes effect on a renewal. Price changes never apply to a period you have already paid for.
5.7 Free tier. The free tier is offered as-is and we may change or discontinue it. We will not reduce features you have already paid for during a paid period.
5.8 Free trials and promotions. Any trial converts to a paid subscription at the end of the trial unless you cancel first. Only one trial per Apple ID unless we state otherwise.
6. Acceptable use
You agree not to:
- Circumvent, disable, or interfere with device attestation, authentication, rate limits, entitlement checks, or any other security or access control;
- Access the Service by automated means other than the documented API with a valid token, or scrape, harvest, or bulk-extract forecast data;
- Resell, sublicense, redistribute, or commercially exploit forecast output, or build a competing forecasting service from data obtained through the Service;
- Reverse engineer, decompile, or disassemble the app or derive our model weights, architecture, or training data, except to the extent this restriction is unenforceable under applicable law;
- Use the Service to violate any law, infringe anyone's rights, or transmit malware;
- Submit content in site names or token labels that is unlawful, infringing, or abusive;
- Misrepresent Stratocheck's output as an official weather product, or attribute to Stratocheck a forecast it did not produce;
- Use the Service in a way that imposes an unreasonable load on our infrastructure, or that degrades it for other users.
We may suspend or terminate access for violations, and we may apply rate limits, quotas, and abuse controls at our discretion.
7. API and agent access
If you mint a personal access token for the Model Context Protocol endpoint:
- The token is personal to you. Do not share it, publish it, or embed it in a product distributed to others. Activity under your token is your responsibility.
- Tokens expire after one year and may be revoked by you or by us at any time, including for abuse or for security reasons.
- Rate limits, daily call limits, and forecast horizon depend on your tier and may change.
- Output obtained through the API is subject to the same restrictions as output in the app, including §3 and §6.
- We may change, deprecate, or withdraw the API. We will make a reasonable effort to give notice, but the API carries no stability or availability commitment.
If you connect Stratocheck to a third-party AI agent or client, you are responsible for what that software does with your token and with the forecast data it receives. We do not control third-party clients.
8. Intellectual property
8.1 Ours. The Stratocheck app, backend, models, model weights, forecast outputs, verification data, designs, and the Stratocheck name and marks are owned by Domisomi and protected by intellectual property law. Nothing in these Terms transfers ownership.
8.2 Your license. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal or internal business purposes.
8.3 Third-party data. GOES satellite imagery is produced by NOAA/NESDIS and is in the public domain as a US Government work. Place-name data derives from GeoNames and is used under the Creative Commons Attribution license. Our processing, model, and outputs are our own.
8.4 Your content. You keep ownership of the site names and token labels you enter. You grant us a limited license to store and process them so the Service can function.
8.5 Verification and marketing. We publish aggregate accuracy statistics and prediction-versus-reality comparisons. These are derived from our forecasts and satellite imagery, not from identifiable user activity. We will not use your named sites, your session history, or any content identifying you in marketing without your separate, explicit opt-in consent, which you may withdraw.
8.6 Feedback. If you send us suggestions, we may use them without restriction, compensation, or obligation to you.
9. Privacy
Our Privacy Policy explains what we collect and why. It is incorporated into these Terms by reference.
10. Third-party services
The Service depends on Apple, Amazon Web Services, and NOAA data feeds. We are not responsible for their availability, performance, or acts. Your use of the App Store is governed by Apple's terms.
11. Changes to the Service and to these Terms
We may modify, suspend, or discontinue any part of the Service. We will make a reasonable effort to give advance notice of a material reduction in features available to paid subscribers, and if we materially reduce what you paid for during a paid period, you may contact us for a pro-rated remedy.
We may update these Terms. We will post the updated version with a new date, and for material changes we will give notice in the app before they take effect. Continued use after that constitutes acceptance. If you do not accept, stop using the Service and cancel any subscription.
12. Termination
You may stop using the Service and delete your account at any time in the app.
We may suspend or terminate your access if you breach these Terms, if we suspect fraud or abuse, if required by law, or if we discontinue the Service. Where practical and lawful, we will give notice and an opportunity to cure. If we terminate your account without cause while you hold a paid subscription, we will provide a pro-rated refund of the unused portion where we are able to.
Sections 3, 6, 8, 13, 14, 15, 16, and 17 survive termination.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, Domisomi disclaims all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We specifically do not warrant that forecasts will be accurate, that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Service will meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOMISOMI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, WASTED EXPENDITURE, OR TRAVEL, EQUIPMENT, OR EVENT COSTS, ARISING FROM OR RELATING TO THE SERVICE — INCLUDING ANY DAMAGES ARISING FROM RELIANCE ON A FORECAST — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
These limits apply regardless of the legal theory and even if a limited remedy fails of its essential purpose. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You acknowledge that these limits are a fundamental basis of the bargain, and that we could not offer the Service at its price without them.
15. Dispute resolution, arbitration, and class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
15.1 Informal resolution first. Before filing anything, email legal@domisomi.com with a description of the dispute and the relief you want. We will do the same for a dispute we have with you. Both of us agree to try in good faith to resolve it for 60 days. This step is a precondition to arbitration.
15.2 Agreement to arbitrate. If we cannot resolve it informally, you and Domisomi agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, administered by JAMS under its Streamlined Arbitration Rules (or, if JAMS is unavailable, by another established arbitration provider we agree on). The Federal Arbitration Act governs this section.
15.3 What is excluded. This section does not apply to: - claims that qualify for small claims court, which either of us may bring there instead; - claims for injunctive relief to stop infringement or misuse of intellectual property; - any claim that applicable law does not permit to be arbitrated.
15.4 Class-action waiver. You and Domisomi each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim or remedy, that claim or remedy is severed from arbitration and proceeds in court; the rest of this section still applies. This waiver does not affect any right you may have to bring a representative action that cannot be waived by law.
15.5 Procedure and costs. Arbitration will be conducted in English. If your claim is $25,000 or less, it will be resolved on documents alone unless you request a hearing, which may be by telephone or video. Where your claim is $10,000 or less, Domisomi will pay your filing, administration, and arbitrator fees unless the arbitrator finds the claim frivolous. Otherwise, fees are allocated under the arbitration provider's rules. The arbitrator may award the same individual relief a court could, and the award is final and binding.
15.6 Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@domisomi.com with the subject line "Arbitration Opt-Out" and including your name and the email address or Apple ID associated with your account. Opting out costs you nothing and does not affect your use of the Service in any way. If you opt out, §16 governs and disputes go to the courts named there.
15.7 Changes. If we materially change this section, the change does not apply to a dispute we already had notice of, and you may reject it by emailing us within 30 days of the change taking effect.
16. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration under §15, you and Domisomi consent to the exclusive jurisdiction of the state and federal courts located in California, and waive any objection to venue there. The UN Convention on Contracts for the International Sale of Goods does not apply.
Nothing here deprives you of the protection of mandatory consumer-protection provisions of the law of the place where you live.
17. Apple-specific terms
These terms apply because you obtained Stratocheck from the Apple App Store, and control over any inconsistency with the rest of these Terms:
- These Terms are between you and Domisomi only, not with Apple. Apple is not responsible for the app or its content.
- Your license to use Stratocheck is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service.
- Apple has no obligation to furnish maintenance or support for Stratocheck.
- If Stratocheck fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Stratocheck.
- Domisomi, not Apple, is responsible for addressing any claim by you or a third party relating to Stratocheck or your possession and use of it, including product liability claims, any claim that Stratocheck fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- Domisomi, not Apple, is responsible for investigating, defending, settling, and discharging any third-party claim that Stratocheck infringes that party's intellectual property rights.
- You represent that you are not located in a country subject to a US government embargo or designated as "terrorist supporting," and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. General
Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Domisomi regarding the Service, superseding any prior agreement on the subject.
Force majeure. We are not liable for failure to perform due to causes beyond our reasonable control, including satellite or ground-station outages, upstream data-provider failures, network or cloud-provider outages, natural disasters, and government action.
Notices. We may give notice through the app, or by email to the address associated with your account. Notices to us go to legal@domisomi.com.
Export. You agree to comply with all applicable export control and sanctions laws.
Language. These Terms are drafted in English, and the English version controls.
